The Rules of Pacers Digest

Hello everyone,

Whether your are a long standing forum member or whether you have just registered today, it's a good idea to read and review the rules below so that you have a very good idea of what to expect when you come to Pacers Digest.

A quick note to new members: Your posts will not immediately show up when you make them. An administrator has to approve at least your first post before the forum software will later upgrade your account to the status of a fully-registered member. This usually happens within a couple of hours or so after your post(s) is/are approved, so you may need to be a little patient at first.

Why do we do this? So that it's more difficult for spammers (be they human or robot) to post, and so users who are banned cannot immediately re-register and start dousing people with verbal flames.

Below are the rules of Pacers Digest. After you have read them, you will have a very good sense of where we are coming from, what we expect, what we don't want to see, and how we react to things.

Rule #1

Pacers Digest is intended to be a place to discuss basketball without having to deal with the kinds of behaviors or attitudes that distract people from sticking with the discussion of the topics at hand. These unwanted distractions can come in many forms, and admittedly it can sometimes be tricky to pin down each and every kind that can rear its ugly head, but we feel that the following examples and explanations cover at least a good portion of that ground and should at least give people a pretty good idea of the kinds of things we actively discourage:

"Anyone who __________ is a liar / a fool / an idiot / a blind homer / has their head buried in the sand / a blind hater / doesn't know basketball / doesn't watch the games"

"People with intelligence will agree with me when I say that __________"

"Only stupid people think / believe / do ___________"

"I can't wait to hear something from PosterX when he/she sees that **insert a given incident or current event that will have probably upset or disappointed PosterX here**"

"He/she is just delusional"

"This thread is stupid / worthless / embarrassing"

"I'm going to take a moment to point and / laugh at PosterX / GroupOfPeopleY who thought / believed *insert though/belief here*"

"Remember when PosterX said OldCommentY that no longer looks good? "

In general, if a comment goes from purely on topic to something 'ad hominem' (personal jabs, personal shots, attacks, flames, however you want to call it, towards a person, or a group of people, or a given city/state/country of people), those are most likely going to be found intolerable.

We also dissuade passive aggressive behavior. This can be various things, but common examples include statements that are basically meant to imply someone is either stupid or otherwise incapable of holding a rational conversation. This can include (but is not limited to) laughing at someone's conclusions rather than offering an honest rebuttal, asking people what game they were watching, or another common problem is Poster X will say "that player isn't that bad" and then Poster Y will say something akin to "LOL you think that player is good". We're not going to tolerate those kinds of comments out of respect for the community at large and for the sake of trying to just have an honest conversation.

Now, does the above cover absolutely every single kind of distraction that is unwanted? Probably not, but you should by now have a good idea of the general types of things we will be discouraging. The above examples are meant to give you a good feel for / idea of what we're looking for. If something new or different than the above happens to come along and results in the same problem (that being, any other attitude or behavior that ultimately distracts from actually just discussing the topic at hand, or that is otherwise disrespectful to other posters), we can and we will take action to curb this as well, so please don't take this to mean that if you managed to technically avoid saying something exactly like one of the above examples that you are then somehow off the hook.

That all having been said, our goal is to do so in a generally kind and respectful way, and that doesn't mean the moment we see something we don't like that somebody is going to be suspended or banned, either. It just means that at the very least we will probably say something about it, quite possibly snipping out the distracting parts of the post in question while leaving alone the parts that are actually just discussing the topics, and in the event of a repeating or excessive problem, then we will start issuing infractions to try to further discourage further repeat problems, and if it just never seems to improve, then finally suspensions or bans will come into play. We would prefer it never went that far, and most of the time for most of our posters, it won't ever have to.

A slip up every once and a while is pretty normal, but, again, when it becomes repetitive or excessive, something will be done. Something occasional is probably going to be let go (within reason), but when it starts to become habitual or otherwise a pattern, odds are very good that we will step in.

There's always a small minority that like to push people's buttons and/or test their own boundaries with regards to the administrators, and in the case of someone acting like that, please be aware that this is not a court of law, but a private website run by people who are simply trying to do the right thing as they see it. If we feel that you are a special case that needs to be dealt with in an exceptional way because your behavior isn't explicitly mirroring one of our above examples of what we generally discourage, we can and we will take atypical action to prevent this from continuing if you are not cooperative with us.

Also please be aware that you will not be given a pass simply by claiming that you were 'only joking,' because quite honestly, when someone really is just joking, for one thing most people tend to pick up on the joke, including the person or group that is the target of the joke, and for another thing, in the event where an honest joke gets taken seriously and it upsets or angers someone, the person who is truly 'only joking' will quite commonly go out of his / her way to apologize and will try to mend fences. People who are dishonest about their statements being 'jokes' do not do so, and in turn that becomes a clear sign of what is really going on. It's nothing new.

In any case, quite frankly, the overall quality and health of the entire forum's community is more important than any one troublesome user will ever be, regardless of exactly how a problem is exhibiting itself, and if it comes down to us having to make a choice between you versus the greater health and happiness of the entire community, the community of this forum will win every time.

Lastly, there are also some posters, who are generally great contributors and do not otherwise cause any problems, who sometimes feel it's their place to provoke or to otherwise 'mess with' that small minority of people described in the last paragraph, and while we possibly might understand why you might feel you WANT to do something like that, the truth is we can't actually tolerate that kind of behavior from you any more than we can tolerate the behavior from them. So if we feel that you are trying to provoke those other posters into doing or saying something that will get themselves into trouble, then we will start to view you as a problem as well, because of the same reason as before: The overall health of the forum comes first, and trying to stir the pot with someone like that doesn't help, it just makes it worse. Some will simply disagree with this philosophy, but if so, then so be it because ultimately we have to do what we think is best so long as it's up to us.

If you see a problem that we haven't addressed, the best and most appropriate course for a forum member to take here is to look over to the left of the post in question. See underneath that poster's name, avatar, and other info, down where there's a little triangle with an exclamation point (!) in it? Click that. That allows you to report the post to the admins so we can definitely notice it and give it a look to see what we feel we should do about it. Beyond that, obviously it's human nature sometimes to want to speak up to the poster in question who has bothered you, but we would ask that you try to refrain from doing so because quite often what happens is two or more posters all start going back and forth about the original offending post, and suddenly the entire thread is off topic or otherwise derailed. So while the urge to police it yourself is understandable, it's best to just report it to us and let us handle it. Thank you!

All of the above is going to be subject to a case by case basis, but generally and broadly speaking, this should give everyone a pretty good idea of how things will typically / most often be handled.

Rule #2

If the actions of an administrator inspire you to make a comment, criticism, or express a concern about it, there is a wrong place and a couple of right places to do so.

The wrong place is to do so in the original thread in which the administrator took action. For example, if a post gets an infraction, or a post gets deleted, or a comment within a larger post gets clipped out, in a thread discussing Paul George, the wrong thing to do is to distract from the discussion of Paul George by adding your off topic thoughts on what the administrator did.

The right places to do so are:

A) Start a thread about the specific incident you want to talk about on the Feedback board. This way you are able to express yourself in an area that doesn't throw another thread off topic, and this way others can add their two cents as well if they wish, and additionally if there's something that needs to be said by the administrators, that is where they will respond to it.

B) Send a private message to the administrators, and they can respond to you that way.

If this is done the wrong way, those comments will be deleted, and if it's a repeating problem then it may also receive an infraction as well.

Rule #3

If a poster is bothering you, and an administrator has not or will not deal with that poster to the extent that you would prefer, you have a powerful tool at your disposal, one that has recently been upgraded and is now better than ever: The ability to ignore a user.

When you ignore a user, you will unfortunately still see some hints of their existence (nothing we can do about that), however, it does the following key things:

A) Any post they make will be completely invisible as you scroll through a thread.

B) The new addition to this feature: If someone QUOTES a user you are ignoring, you do not have to read who it was, or what that poster said, unless you go out of your way to click on a link to find out who it is and what they said.

To utilize this feature, from any page on Pacers Digest, scroll to the top of the page, look to the top right where it says 'Settings' and click that. From the settings page, look to the left side of the page where it says 'My Settings', and look down from there until you see 'Edit Ignore List' and click that. From here, it will say 'Add a Member to Your List...' Beneath that, click in the text box to the right of 'User Name', type in or copy & paste the username of the poster you are ignoring, and once their name is in the box, look over to the far right and click the 'Okay' button. All done!

Rule #4

Regarding infractions, currently they carry a value of one point each, and that point will expire in 31 days. If at any point a poster is carrying three points at the same time, that poster will be suspended until the oldest of the three points expires.

Rule #5

When you share or paste content or articles from another website, you must include the URL/link back to where you found it, who wrote it, and what website it's from. Said content will be removed if this doesn't happen.

An example:

If I copy and paste an article from the Indianapolis Star website, I would post something like this:

http://www.linktothearticlegoeshere.com/article
Title of the Article
Author's Name
Indianapolis Star

Rule #6

We cannot tolerate illegal videos on Pacers Digest. This means do not share any links to them, do not mention any websites that host them or link to them, do not describe how to find them in any way, and do not ask about them. Posts doing anything of the sort will be removed, the offenders will be contacted privately, and if the problem becomes habitual, you will be suspended, and if it still persists, you will probably be banned.

The legal means of watching or listening to NBA games are NBA League Pass Broadband (for US, or for International; both cost money) and NBA Audio League Pass (which is free). Look for them on NBA.com.

Rule #7

Provocative statements in a signature, or as an avatar, or as the 'tagline' beneath a poster's username (where it says 'Member' or 'Administrator' by default, if it is not altered) are an unwanted distraction that will more than likely be removed on sight. There can be shades of gray to this, but in general this could be something political or religious that is likely going to provoke or upset people, or otherwise something that is mean-spirited at the expense of a poster, a group of people, or a population.

It may or may not go without saying, but this goes for threads and posts as well, particularly when it's not made on the off-topic board (Market Square).

We do make exceptions if we feel the content is both innocuous and unlikely to cause social problems on the forum (such as wishing someone a Merry Christmas or a Happy Easter), and we also also make exceptions if such topics come up with regards to a sports figure (such as the Lance Stephenson situation bringing up discussions of domestic abuse and the law, or when Jason Collins came out as gay and how that lead to some discussion about gay rights).

However, once the discussion seems to be more/mostly about the political issues instead of the sports figure or his specific situation, the thread is usually closed.

Rule #8

We prefer self-restraint and/or modesty when making jokes or off topic comments in a sports discussion thread. They can be fun, but sometimes they derail or distract from a topic, and we don't want to see that happen. If we feel it is a problem, we will either delete or move those posts from the thread.

Rule #9

Generally speaking, we try to be a "PG-13" rated board, and we don't want to see sexual content or similarly suggestive content. Vulgarity is a more muddled issue, though again we prefer things to lean more towards "PG-13" than "R". If we feel things have gone too far, we will step in.

Rule #10

We like small signatures, not big signatures. The bigger the signature, the more likely it is an annoying or distracting signature.

Rule #11

Do not advertise anything without talking about it with the administrators first. This includes advertising with your signature, with your avatar, through private messaging, and/or by making a thread or post.

Report: Big Ben Told Cops No Sex with Accuser

Posted Mar 10th 2010 6:55PM by TMZ Staff

Ben Roethlisberger told police that he never had sex with his accuser, but admitted she bumped her head after the two made "contact" in the bathroom -- this according to a new report.

KDKA in Pittsburgh claims they spoke with insiders who claim Ben told Milledgeville police that the woman "slipped and fell" after an incident in the bathroom at the Capital City nightclub.

According to the report, the woman suffered injuries to her head.

This is going to get ugly. At least there's still time for the Steelers to draft a QB.
Why do the things that we treasure most, slip away in time
Till to the music we grow deaf, to God's beauty blind
Why do the things that connect us slowly pull us apart?
Till we fall away in our own darkness, a stranger to our own hearts
And life itself, rushing over me
Life itself, the wind in black elms,
Life itself in your heart and in your eyes, I can't make it without you

Well you did bring Randle El back.. but seriously there's not much as far as good QB's to choose from this year.

There's a great piece of satire I read yesterday that Randel El was brought back to be Ben's replacement. It was pretty good... it could have passed for being serious.

I'm happy that Randel El is back in the picture. Since Sweed was a bust, we've finally got four legit WRs. We were already planning to refocus more emphasis to the running game. We're loaded with quality weapons on both sides of the ball, but obviously we need a competent QB to manage things for us.

              Latest On Roethlisberger Investigation

It's so narrow and so cramped you can barely turn around. Its floor is filthy. It has one basin and one toilet. And it's the place where a 20-year-old college student says Ben Roethlisberger attacked her.

The squalid bathroom in a college town drinking establishment is now a crime scene and a major focus of an investigation that has already put Roethlisberger in a bad situation, a situation that could become catastrophic if the police and the prosecutor in Milledgeville, Ga., decide to charge him with sexual assault.

              [+] EnlargeCapital City Bar
AP Photo/John AmisThe Capital City bar in Milledgeville, Ga., is the focus of the Ben Roethlisberger investigation.

In his attempt to respond to the woman's assertions, Roethlisberger has hired Ed Garland, one of America's greatest criminal defense lawyers.

              Will it be enough?

Can Garland and his team of expert investigators put together enough evidence to show that the accuser was lying and confabulating when she told them that Roethlisberger assaulted her?

Here is a list of the factors the authorities and Garland are analyzing as the investigation continues through the next few days to a decision whether or not to charge, which is likely to come next week:

              Accuser's veracity and sobriety

The accuser has given the police a detailed version of what happened to her. Milledgeville police, assisted by state agents, are checking on each of her details. They're looking for any shred of evidence that would confirm or contradict what she has told them. If they are able to find any forensic evidence in the bathroom, it will be a critical factor.

They are also determining whether the accuser was drinking, how much she drank and how long she drank. They will gather cash register and service records and interview friends who accompanied her. Prosecutors are loathe to file sexual assault charges when the accuser is in the brownout or blackout stage of intoxication.

              Evidence of injury

The accuser was in a local hospital emergency room shortly after she says she was attacked. As soon as she told her story of what happened, the nurses and doctors on duty went into the procedures that are required after an allegation of sexual assault. Known as a "rape kit," these procedures are designed to gather and to preserve any indication of injury that could help determine the truth of the accuser's allegations.

If there is evidence of an injury that could result only from a forcible, violent sexual assault, Roethlisberger has a serious problem. It was incontrovertible injury evidence (a vaginal abrasion) that was a major factor in a jury's decision 18 years ago that sent Mike Tyson to jail for three years.

              Security cameras

There were 12 security cameras operating in the 7,000-square-foot pub. Although the police are refusing to respond to any questions about the tape, it appears that video is available. It is not known whether the cameras showed the bathroom. Nor is it yet known whether the cameras show the accuser and Roethlisberger entering and exiting the bathroom. It is easy to overestimate the value and the importance of security camera evidence, but it may be a factor as police and prosecutors decide whether to charge Roethlisberger.

              "Outcry" witnesses

Police and prosecutors rely on witnesses who are able to describe the accuser's condition in the moments after the attack. A description of an accuser in hysterics or in shocked disbelief can be important to a prosecutor. Both the police and attorney Garland are interviewing any "outcry" witness who may have seen or even talked with the accuser after the alleged incident.

An outcry witness was powerful evidence against Tyson. When the victim, Desiree Washington, fled Tyson's hotel room in Indianapolis, she returned to her hotel in Tyson's limo. The driver, Virginia Foster, told the jury that she saw a sobbing woman in near hysterics and heard her crying, "I can't believe he did that."

In the Kobe Bryant investigation in Eagle, Colo., there were two outcry witnesses, one who said the victim was disheveled and crying and another who said the victim as perfectly normal. Prosecutors dropped the case against Bryant.

              Previous predatory conduct

In trials on charges of sexual assault, the law frequently allows prosecutors to show the jury that the accused has been accused of previous sexual misconduct. If a prosecutor can show another incident of predatory conduct, it can become the turning point of the trial.

In the trial of sexual assault charges against broadcaster Marv Albert in Arlington, Va., the brilliant defense attorney, Roy Black, was leading Albert to an obvious not guilty verdict until the prosecutors, in a major surprise, brought in a second woman who told the jury that Albert had attacked her in the same way. After listening to the second woman's story, Albert and Black told the judge they would be entering a plea of guilty.

If the prosecutor in Milledgeville decides to charge Roethlisberger, he will, of course, look hard at the civil assault suit filed against Roethlisberger last July in Nevada. Although lawyers and scholars are not in complete agreement on the issue, it appears that the law of Georgia would permit the use of previous predatory conduct as part of the prosecution's evidence.

              Bathroom dimensions

The last NFL star accused of a sexual assault in a small bathroom was former Green Bay Packers TE Mark Chmura. The accuser claimed that Chmura grabbed her and pulled her into the bathroom and raped her. Among the many holes in her bogus story was the bathroom itself.

Chmura's attorney, Gerry Boyle of Milwaukee, brought into the courtroom a model of the bathroom with its walls cut off four feet above the bathroom floor. It was not a scale model. It was the exact size and dimensions of the bathroom. When, during his cross examination, Boyle led the accuser to the actual-size model to demonstrate that her story was physically impossible, she stepped back from the model and exclaimed, "That's not it. It is too small." The jury deliberated less than an hour in reaching a not guilty verdict.

              Garland factor

In the patois of lawyers and judges, Roethlisberger's lawyer, Ed Garland, is a "miracle worker." Garland offers a rare combination of a dramatic and compelling courtroom appearance and remarkable pre-trial investigative skills. In his defense of Ray Lewis against a double murder charge, Garland's superior preparation and courtroom dexterity humiliated Atlanta prosecutors and allowed Lewis to walk away from a difficult situation on a plea of guilty to obstruction of justice.

Any discussion of smart things that Roethlisberger has done lately is a short discussion, but it's a discussion that should focus on Garland and his ability to turn around what appears to be a hopeless situation. Roethlisberger has hired the right lawyer. His work for Roethlisberger will be top-of-the-line legal work; it will be expensive; and, it will be worth every dollar.

What happened in the dingy bathroom? The accuser says one thing. Roethlisberger says another. But it's not merely he-said-she-said. The evidence from the bathroom itself, the hospital and the witnesses will determine who is telling the truth.

Officers posed for photos with QB hours before complaint

                Jonathan Jackson The Union-Recorder

MILLEDGEVILLE — The patrol officer who initially investigated the sexual assault complaint against Ben Roethlisberger posed for photographs with the Pittsburgh Steelers quarterback an hour before his accused filed her complaint.

Sgt. Jerry Blash, who subsequently wrote a sparse incident report that did not name Roethlisberger, had a close-up picture taken with the celebrity football player inside a local bar and, later, outside the bar with a group of other officers.

Police Chief Woodrow Blue said he was not troubled by the photographs, adding that his officers handled the case correctly from the onset.

“The photographs did not and have not affected the investigation at all,” said Blue.

And while Blash, an eight-year veteran of the Milledgeville Police Department, was the officer approached by the alleged victim and the officer who wrote the incident report, Blue said Blash had little involvement in the subsequent investigation.

Questions about whether Blash filed a more detailed narrative and who took over the investigation from him were rebuffed by the chief on the grounds he could not discuss such details because of the ongoing investigation.

Blue did indicate that once his department and the Georgia Bureau of Investigation complete their inquiry, they will turn their information over to District Attorney Fred Bright for a determination on whether to file charges in the case

Ben Roethlisberger Hires High Profile Private Dick

Posted Mar 12th 2010 11:13AM by TMZ Staff

Ben Roethlisberger just added another elite member to his defense team -- a famous private investigator who's handled several high profile celebrity cases before.

TMZ has learned the P.I. is Charles Mittelstadt -- who has worked as a lead investigator on behalf of NFL stars like Ray Lewis and Jamal Lewis. Mittelstadt has also worked for rapper T.I. and convicted Olympic bomber Eric Rudolph.

Hiring a private investigator is a sign that the alleged victim is fair game. In this case, as we already reported, law enforcement tells us alcohol was a factor.

It's a safe bet the P.I. will go down that road ... as well as others.

Questions of credibility, consent and science likely are guiding Georgia authorities as they investigate a sex assault allegation against Ben Roethlisberger, lawyers and police say.

Answering those questions -- and deciding whether to charge the two-time Super Bowl champion -- could take months.

"Sex assault cases often take longer to investigate than other crimes because we'll exhaust all options, check every fact and interview everyone we can, multiple times, before we take someone to jail," said Pittsburgh police Sgt. Larry Scirotto, who isn't involved in the investigation.

A 20-year-old student at Georgia College & State University told police in Milledgeville, Ga., that Roethlisberger, 28, assaulted her in a bathroom near a VIP room of the Capital City bar late March 4 or early March 5. Police released few details about what she told them.

Investigators requested a DNA sample from Roethlisberger, although they did not say what kind of evidence they collected to which it could be compared.

In Pittsburgh, results of DNA testing can take six to eight weeks on average, said Downtown criminal defense attorney Bill Difenderfer.

"DNA has been nothing short of a revolution in cases of sex assault allegations," said University of Pittsburgh law professor David Harris. "They can prove that there was activity between two people, if there is any question of the person being accused not being the right one."

In Milledgeville, former Assistant District Attorney Carl Cansino said investigators are "moving very deliberately here."

"It will take a while," said Cansino, a defense attorney in the Ocmulgee Judicial Circuit of central Georgia's state court that would hear the Roethlisberger case if it goes to court.

"The Georgia Bureau of Investigation must do all the interviews. Then the agents will submit the evidence they gather in an official report to the district attorney, Fred Bright," Cansino explained. "Fred is meticulous. He's going to spread all that evidence out on a big table. He and his staff will look at all the evidence, taking it all in, looking at the case like they would a big ball of wax to see if there are chargeable offenses."

Roethlisberger can invoke his Fifth Amendment right against self-incrimination and refuse to give a statement to investigators, who said they want to interview him and about eight people with him that night.

Investigators can get a search warrant for his DNA, Difenderfer said. Georgia authorities have not asked for one, according to the Baldwin County Clerk of Courts and the magistrate court in Milledgeville.

"If Big Ben doesn't give a statement, that in and of itself sends a very loud message to the cops," Difenderfer said. "It makes him look guilty. But it would be smart for his attorney to put the statement off for a while, until he knows what the full allegations are and what evidence the police do or do not have."

Roethlisberger attorney Edward T.M. Garland did not return a call seeking comment.

The issue of consent can be critical in sexual assault cases and "often very difficult to prove," Scirotto said.

In a sexual situation, someone can revoke consent and say "No" at any time, "and then it's no longer consensual activity," Harris said.

"These cases often come down to one person's word against another, and that's where even DNA evidence won't prove who is telling the truth," Harris said. "That's why you take your time, you run down all the facts and go very slowly, very carefully, and you see whose story matches the facts. Is one person more consistent than another? Does one person have a questionable background?"

The fact that Roethlisberger faces an accusation of sexual assault in Nevada could "taint" him, at least in public opinion, lawyers say. A former employee of Harrah's Casino in Lake Tahoe sued Roethlisberger last year, but no criminal charges were brought. The civil case is pending.

"This new allegation coming up with that prior case hanging out there is just horrible news for Roethlisberger," Difenderfer said. "Whether he did anything wrong or not, the public will believe he has a problem, and that this signals a pattern. He's tainted, his reputation will never recover."

Re: Ben Roethlisberger accused of sexual assault by another woman

Since the first case went away from a criminal standpoint I can see Ben's team trying to make hay by discrediting the first person even more so that they can play Ben as an 'easy target' for this type of 'extortion'.

IOW, insteading of trying to hide from the other case, they'll try and spin it to their favor. It wouldn't even surprise me to see that civil case settled privately for close to what is being asked for in exchange for the 'victim' to make a statement absolving Ben of any wrongdoing.
Nuntius was right for a while. I was wrong for a while. But ultimately I was right and Frank Vogel has been let go.

I think a lot of it hinges on the results from her exam at the hospital afterwards. Depending on what they find and where they find it, it might throw an entirely different light on things.

Ben DNA 'down there' would be a really bad thing. And then there's Ben's statement of 'I did not have sexual intercourse' with her. Hmmmmmm - where have we heard something like that before ?? I would guess that sexual assault doesn't have to involve intercourse.

Yeah ........... good time for me to bow out of this thread until further notice.

MILLEDGEVILLE, Ga. -- A young woman told Channel 4 Action News on Friday that she was one of about 20 who partied with Ben Roethlisberger at a nightclub last week on the night that a female college student told police she was sexually assaulted by the Pittsburgh Steelers quarterback.

"Everyone keeps talking about how nice he was. He was not nice," the woman said.

The woman -- who asked not to be identified -- told reporter Ari Hait that people who were with Roethlisberger invited her into the VIP area of the the Capital City club.

"A bunch of big guys were like, 'Come back in here,' and I was like, I'm just trying to have fun, whatever," she said.

She said that women were fawning over the star quarterback, and that he hit on her but she wasn't interested and didn't like the way he was acting, so she left.

"He bought a round of shots for girls and said, 'All you *****es, take my shots,' and I got pissed because that's very rude and disrespectful to call girls a bunch of *****es," she said.

Before she left, she said she saw Roethlisberger with the woman who would eventually become his accuser. She didn't think anything of it until the next morning when she heard about the accusations.

"The fact that people are talking about how he's such a nice guy at the bar, buying us a bunch of shots, because there's a bunch of drunk girls happy that they're getting free shots -- he was very arrogant," she said.

Roethlisberger has not been charged with any crimes. The Georgia Bureau of Investigation is continuing to look into the 20-year-old woman's claims of what happened to her in the early-morning hours of March 5.

Atlanta attorney Ed Garland has been hired by Roethlisberger, and the lawyer had private investigator Charles Mittelstadt in Milledgeville on Friday to ask questions and try to figure out what happened on the night in question. Mittelstadt has worked on behalf of Baltimore Ravens star Ray Lewis and rapper T.I. in the past.

"I won't comment specifically about any particular aspect, but I think you can assume that we're looking into all aspects of this allegation," Mittelstadt told Channel 4 Action News on Friday.

Also on Friday, the local Union-Recorder newspaper published a photo that shows Milledgeville Police Sgt. Jerry Blash posing with his arm around Roethlisberger hours before the alleged victim approached Blash to report that she was assaulted.

Police Chief Woodrow Blue told the newspaper that even though Blash wrote the incident report -- which did not include Roethlisberger's name -- he had little involvement in the subsequent investigation and the picture of Blash with Roethlisberger did not affect the investigation "at all."

The Georgia Bureau of Investigation is handling the majority of the investigation because of the Milledgeville Police Department's limited resources.

According to Carl Cansino, a lawyer for Capital City, Blash came to the nightclub to arrange the VIP room for Roethlisberger and his friends.

Cansino said he doesn't know if Blash was focused on helping Roethlisberger or if he was trying to keep the streets safe.

"It could even be crowd control -- like, say, there's a lot of people in the line there, maybe at the instruction of one of them, can you see if you can get us in so we can get off the street because we're just tired of maybe giving autographs or whatever the case may be," Cansino said.

                              Roethlisberger Party Dubbed 'Ben-a-Palooza'

Posted Mar 14th 2010 6:00AM by TMZ Staff

Most of Ben Roethlisberger's ill-fated party weekend was thoroughly planned out weeks in advance -- minus the whole alleged sexual assault part -- and TMZ has learned the festivities even had a name ... "Ben-a-Palooza."

                              Ben Roethlisberger

The Palooza is a tradition that Ben and his pals have put together for the past several years -- in which the Steelers quarterback and a group of his friends celebrate Ben's birthday together.

This year, Ben-a-Palooza began at Roethlisberger's home near Pittsburgh, where the group -- pictured above wearing customized Palooza shirts -- boarded a party bus bound for Ben's lake house in Georgia.

After the bus arrived to the home, several members spent one of the nights on a bar crawl in Milledgeville -- where Ben was later accused of sexually assaulting a 20-year-old woman in a nightclub bathroom.

Nothing spoils a Palooza like a criminal investigation.

Report: Roethlisberger agrees to provide DNA sample, submit to interview
Posted by Mike Florio on March 14, 2010 10:21 PM ET
Buried in the middle of a lengthy article from the Pittsburgh Tribune-Review regarding the night that culminated in the latest sexual assault charge against Ben Roethlisberger is a tidbit we previously have seen nowhere else.

According to Carl Prine of the Tribune-Review, attorney Ed Garland has agreed to arrange for Roethlisberger to meet with police and to provide a DNA sample.

Prior reports indicated that Garland had not agreed to the interview or the DNA sample.

Roethlisberger was interviewed by authorities on the evening that the sexual assault charge was made.
