    It's not really that cut and dry.

    For example, there's been no consideration yet by either side which is a requirement to have a legal binding contract. Also, Danny or McRoberts could argue that a premise of his verbal agreement to Miami was that Lebron would return to the team.

    Here's a line right from the Florida bar "Generally other than those required by law to be in writing, verbal contracts are enforceable in Florida, especially in situations where one party has performed his or her obligations."

    Well in this case neither party has performed their obligations. It's also possible (thought I don't know for sure how it works in Flordia) that any contracts greater the period of a year need to be in writing. A good example of how a verbal agreement is not always binding in the NBA is the Asik trade for the Rockets and Pelicans which was agreed to 10 or so days ago. There were rumors that the Rockets would choose not to go forward with the agreement depending on what happened with Chris Bosh.

    Don't assume that general contract law applies to the NBA. The CBA could easily have a clause that negates verbal agreements as binding contracts. As well verbal contracts tend to not hold up well in court as it is hard to prove you actually had a verbal contract. There is also a difference between agreeing to terms and creating a binding contract. The fact that no team can sign a free agent to a contract prior to July 11th suggests that Danny has every right to back out of the agreement prior to signing his name on the contract.
