    Default Divorce question ....

    I have a friend who just filed for a divorce. She's afraid her husband will refuse to sign even though she moved out a year ago and hasn't wavered in her decision once.

    What happens if he refuses to sign, does anyone know?

    If not she'll ask her lawyer on Monday, but I was curious myself.

    Funny I just watched a TV show where someone was "refusing" to sign divorce papers. This is a myth. If someone has filed for a divorce, it's going down. The only thing at question are the conditions of the divorce. The rules vary from state to state.

    What a person CAN do is refuse the proposed conditions (who gets what stuff, who pays for what, who gets the kids, when do you get to see the kids, etc.)

    If the divorce is not amicable, it can drag out for a while as you deal with lawyers and judges.

    But no, your marriage status can not be held hostage by another person for ever and ever. That's a complete myth. Once someone has filed for divorce, it's going to happen sooner or later and you just hope for sooner.

    And by the way, I know a specific case where someone tried to hide from getting served papers in order to avoid the inevitable.

    When the person kept not showing up, the judge showed no mercy.

    They stamped the divorce into effect and gave everything - I mean EVERYTHING - to the petitioning party. Poorly played, hold-out guy. Very poorly played, indeed.

    I knew you couldn't be held hostage. lol

    She had him sign away his right to any say in the sale of the house immediately before he knew how serious she was. He though it was a phase or something. It was before she moved out.

    The only sticking point might be the car. It has her name on it and she put in there he has 30 days to remove it.

    Everything else she's fine with him having if he wants to argue over it.

    She's all worried however.
