Can any team not playing anymore start trading or do they have to wait until the draft?

The draft. Depending on the CBA status, however, teams may hold off to see if there's a lockout or not.

Keep in mind that doesn't mean that GM's can't talk with other GM's before they can make trades. At least I think they can.

I thought trades could take place as soon as the NBA Finals are over. I'm pretty sure in past years trades have taken place before the draft

Teams can make trades as soon as their season ends, but players whose contracts are ending cannot be traded during this period (the team must wait and let them become free agents on July 1). So theoretically, two teams no longer in the playoffs could trade players whose deals aren't expiring. However, usually no moves are made until just before the draft, and then deals often involve draft picks rather than players.
